Buenos Aires, October 15 (PR/26) — The Argentine government has filed a request for provisional measures with the International Tribunal for the Law of the Sea (ITLOS) seeking to prevent the United Kingdom from exploiting hydrocarbons on the continental shelf of the North Falkland Basin.
The Office of the President reported that the filing seeks to safeguard Argentina’s sovereign rights over its continental shelf and prevent activities unilaterally authorized by the United Kingdom from aggravating the dispute recognized by the United Nations.
According to the official statement, the measure forms part of the arbitral proceedings initiated by the national government on September 28, pursuant to Annex VII of the United Nations Convention on the Law of the Sea (UNCLOS), to defend Argentina’s sovereignty and natural resources.
The Executive Branch stated that the request is based on Article 290, paragraph 5, of UNCLOS, which allows provisional measures to be requested while an arbitral tribunal is being constituted, in order to preserve the parties’ respective rights or prevent serious harm to the marine environment, where the urgency of the situation so requires.
The Argentine Republic also reaffirmed its sovereign rights over the Falkland Islands (Islas Malvinas), South Georgia and the South Sandwich Islands, as well as the surrounding maritime areas, declaring: “By history and by law, the Malvinas belong to Argentina.”
